By using the website and services, you agree to be bound by these Terms and Conditions and our Privacy Policy. In these Terms and Conditions, the word “website” refers to the PresRide website; the terms “we”, “us”, “our” and “PresRide” refer to PresRide, DBA of LVC Luxury Transportation Service Corp; and the terms “you”, “client”, and “user” refer to you, the PresRide client.

For purposes of these Terms and Conditions, references to the “website” and “services” also include any PresRide mobile applications made available through the Apple App Store, Google Play Store or other official distribution platforms, as well as any related functionalities such as real-time trip tracking, notifications and in-app account management.

The following terms and conditions apply to the website and services offered by PresRide. This includes the mobile and tablet versions as well as any other version of PresRide accessible via desktop, mobile, tablet, social media or other devices.

READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING OR OBTAINING ANY INFORMATION OR SERVICE FROM PRESRIDE.

1. ACCEPTANCE OF TERMS

This agreement sets forth legally binding terms for your use of PresRide. By using the website and services, you agree to be bound by this agreement. If you do not agree to the terms of this agreement, you must not use the website and services. We may modify this agreement from time to time, and such modification shall be effective upon posting on the website. You agree to be bound by any modifications to these terms and conditions when you use the website and the services offered on the website after such modification is posted on the website; therefore, it is important that you review this agreement regularly.

The services are not directed to persons under the age of 13. PresRide does not knowingly collect information from persons under the age of 13. If you are under the age of 13, please do not submit any personal information about yourself to PresRide unless you have proper authorization from a parent or appropriate legal guardian. It is the responsibility of parents and legal guardians to determine whether any of the content and services offered on the website is appropriate for their children or minors under their guardianship.

PresRide may, in its sole discretion, refuse to offer the services to any entity and change its eligibility criteria at any time. This provision is void where prohibited by law and the right to access the service and the website is revoked in such jurisdictions.

The website and services may only be used in compliance with these terms and all applicable local, state, national and international laws, rules and regulations.

By using the website and services, you represent and warrant that you have the full right, power and authority to enter into this agreement and to fully perform all of your obligations hereunder. You further represent and warrant that you are under no legal disability or contractual restriction that prevents you from entering into this agreement.

By creating an account, downloading or using any PresRide mobile application, or booking services through the application, you also represent and warrant that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is higher, and that you have the legal capacity to enter into binding contracts.

2. NOTIFICATIONS AND NEWSLETTER

By providing PresRide with your email address and telephone number, you agree that we may use your email address to send you important notifications and communications about our services, news and special content. If you do not wish to receive these emails, you may opt-out of receiving them by sending us your request through our contact information or by using the “unsubscribe” option in the emails. Opting out may prevent you from receiving emails regarding our services, important news and special content.

When you use the PresRide mobile application, you may also receive push notifications related to trip status, driver assignment, service updates, security alerts, operational communications and, where permitted by law, promotional messages. You can manage or disable push notifications at any time through your device settings; however, disabling certain operational notifications may affect your ability to receive real-time updates about your trips and services.

3. SERVICES

PresRide facilitates access to certified and authorized luxury vehicle drivers, licensed under TLC, to provide professional transportation services.

Services can be booked through the website. The user must select the pick-up point and the destination point. Service rates can be calculated based on the route or the hours scheduled and requested for the service. The user will be able to select the type of vehicle at the time of scheduling the service.

Users must indicate their location and destination at the time of requesting the service and PresRide will search for the driver that best suits their specifications, location and destination.

When accessing the services through the PresRide mobile application or any technology used to track or manage rides, you expressly authorize PresRide to access and use location data from your device for the purposes of identifying your approximate position, assigning drivers, determining pick-up and drop-off points, displaying trip status, route optimization and contributing to safety during the provision of transportation services. The availability and accuracy of location data may depend on your device settings, GPS, wireless networks and other factors beyond PresRide’s control.

Once the service is scheduled, the user authorizes PresRide to communicate with the driver for the purpose of monitoring the trip, assisting the driver with directions or misrouting, course corrections, safety reasons or for any other reason PresRide deems necessary for the proper provision of the service.

Users may also request service for someone other than the person requesting the service. In that case the user may request and pay for the service by providing the details of the passenger, the address, date and time of collection and can track the route through our notifications, until its completion. At the time of making the request for the service, the user must indicate that the service is for another person or persons and authorizes us to send communications and notifications about the development of the route until its completion.

In case of any complaint or problem related to the service or the driver providing the service, you should contact PresRide to handle the complaint. PresRide will receive your complaint through our helpdesk and will work promptly to resolve any complaint or problem you may have regarding our service. You will be required to provide us with the necessary information to enable a prompt and appropriate resolution of your complaint or problem.

You agree and acknowledge that you will not use PresRide services in cases of medical emergency. In cases of emergency, please seek emergency medical services. PresRide is not a provider of emergency medical transportation services.

You understand and agree that situations beyond our control may arise in which drivers become lost, have an accident during the pick-up route, or fail to respond to requests PresRide communicates to you regarding your specifications. PresRide services and third party services requested by users are not infallible, the user accepts the risks that may occur during the provision of the services.

Passengers must behave in a respectful and courteous manner with drivers at all times. PresRide reserves the right to cancel any service if drivers threaten their physical or moral safety, the safety of the vehicle or the safety of other passengers, or passengers engage in rude, abusive, disrespectful, threatening or other behavior that may be considered by any person to be objectionable.

The user declares and accepts that PresRide services are provided through affiliated third party companies. The drivers providing the transportation services requested by users are partners and affiliates and are not employees of PresRide.

PresRide may also provide and operate its transportation services through third-party technology platforms under a white-label or licensing model for purposes including, but not limited to, booking management, trip dispatch, live tracking, notifications and operational control. While PresRide seeks to use reliable and industry-standard technology, you acknowledge that certain technical incidents or interruptions may arise that are attributable to such third-party providers and may temporarily affect the availability or performance of the services.

PresRide may cancel any service and may change or discontinue the availability of services any time in its sole discretion.

Operational policies (billing, behavior and use of vehicles)

In addition to the provisions above, the following operational rules apply to all services:

Waiting time, delays and excesses. Each service may include a standard waiting time at pickup, as specified during booking or in the applicable tariff schedule. Any additional waiting time beyond the included period may be charged to your payment method at the applicable per-minute or per-hour rate, together with any associated parking or standing charges. If the passenger is not present at the pickup location within a reasonable time, the trip may be considered a no-show under Section 6 and billed accordingly.

Child safety seats (asientos de coche). Unless expressly stated in the booking confirmation, PresRide does not guarantee the availability of child safety seats, booster seats or other child restraints. Where such equipment is available, it may be subject to additional charges. You are solely responsible for requesting the correct type and number of child seats and for ensuring that children are properly secured in accordance with applicable law. PresRide and its drivers are not responsible for injuries or damages arising from the improper use, installation or absence of child safety restraints.

Vehicle cleanliness (limpieza). Passengers must maintain reasonable cleanliness inside the vehicle. If, in the driver’s reasonable judgment, a passenger soils the vehicle beyond normal use (including but not limited to spills of food or drink, mud, excessive dirt, bodily fluids, smoke odor or similar), PresRide may charge a cleaning fee to your stored payment method in an amount sufficient to cover cleaning, detailing, vehicle downtime and administrative costs.

Damages and losses to property (daños y perjuicios). You are responsible for any damage to the vehicle or equipment (including upholstery, interior, exterior, electronic systems and accessories) caused by you or any passenger in your party, beyond normal wear and tear. PresRide may charge your payment method for the reasonable costs of repair, replacement, loss of income and associated administrative expenses.

Drugs, alcohol and substances (drogas y alcohol). The possession, consumption or distribution of illegal drugs in any PresRide vehicle is strictly prohibited. Alcohol consumption is only permitted where allowed by local law and provided that such consumption does not compromise safety, disturb the driver or violate any regulation applicable to the vehicle or route. The driver may terminate the service immediately, without refund, in case of intoxication, disorderly conduct, possession of illegal substances or any behavior that endangers safety.

Lost or forgotten items (objetos perdidos). PresRide and its drivers are not responsible for any property lost, forgotten or left behind in a vehicle. As a courtesy, PresRide may assist you in attempting to locate and recover lost items; however, we make no guarantee that items will be found or returned. Any costs associated with the retrieval, storage or delivery of lost items may be charged to your payment method.

Pickup and drop-off locations (lugares de recogida y entrega). You must ensure that pickup and drop-off locations are safe, lawful and reasonably accessible for the vehicle type selected. PresRide is not responsible for delays or service limitations due to road closures, police or security restrictions, building rules, loading restrictions or other access constraints. Where the driver is unable to access the exact address, you may be required to meet the vehicle at an alternative nearby point; waiting time or detours may be billed accordingly.

Seat capacity and luggage (capacidad de asientos). The number of passengers and the volume of luggage must not exceed the legal or recommended capacity of the selected vehicle. The driver may refuse to transport additional passengers or luggage that would compromise safety, comfort or legal compliance. No refunds will be issued where service limitations result from overcapacity.

No-smoking policy (de fumar). Smoking and vaping of any substance, including electronic cigarettes, is strictly prohibited in all PresRide vehicles. Evidence of smoking (including odor, ashes, burns or residue) may result in a cleaning fee and, where applicable, damage charges, which may be billed to your payment method.

Passenger behavior and safety (comportamiento de los pasajeros). Without limiting any other provision of these Terms, passengers must at all times follow the driver’s reasonable safety instructions, use seatbelts where available, refrain from distracting the driver, and behave respectfully toward the driver and other passengers. Aggressive, discriminatory, harassing or unsafe conduct may result in immediate termination of the trip without refund and may lead to suspension or closure of your PresRide account.

Trip updates and travel notifications (actualizaciones de viaje). During a booking, PresRide may send you real-time status information, including driver approach notifications, vehicle location, estimated arrival times, route changes and completion confirmations. Such updates may be provided via push notifications, SMS, in-app messages or email. By using the services, you consent to receiving these operational communications, which are considered essential to the provision of the service.

Miscellaneous charges (misceláneas). In addition to base fares and time/distance charges, your final bill may include tolls, surcharges, airport or port fees, parking fees, cleaning fees, damage fees, waiting time charges, extra stops, out-of-route detours approved by you, and other ancillary charges disclosed in the booking process or in the applicable tariff schedule. By confirming a booking, you authorize PresRide to charge such amounts to your stored payment method as part of the final settlement of the trip.

4. ACCOUNT REGISTRATION AND SECURITY

In order to access certain features of the website or to use the PresRide mobile application, you may be required to create a user account, provide certain registration details and set up login credentials. You agree to provide true, accurate, current and complete information during registration and to keep such information up to date at all times.

You are solely responsible for maintaining the confidentiality of your login credentials, including your username, password and any authentication codes associated with your account, and for all activities that occur under your account. You agree to immediately notify PresRide of any unauthorized use of your account or any other breach of security.

PresRide reserves the right, in its sole discretion, to suspend, restrict or permanently deactivate any account in cases of suspected fraud, misuse of the services, violation of these Terms and Conditions, security risks or any conduct that PresRide reasonably considers harmful to its interests, other users, drivers or third parties.

You acknowledge that deleting or uninstalling the PresRide mobile application from your device does not, by itself, close your PresRide account or terminate your obligations under these Terms and Conditions. If you wish to close your account, you must contact us through our contact information or follow the account closure process, if available, in the website or mobile application.

5. PAYMENTS

Users will make bookings of services through the website. All services booked through the website must be paid online at the time of booking by credit or debit card via Stripe (payment processor available on the website).

The service will be billed according to the service type selected by the user (point-to-point or hourly) and the selected vehicle. The total value of the service will be displayed at checkout before confirming the booking. Once the user confirms, the full payment will be processed immediately.

Upon successful payment, an electronic receipt will be sent to the user’s email address with the transaction details and confirmation of the scheduled service.

If you request extra services after completing the booking (e.g., additional stops, waiting time, upgrades), you authorize PresRide to charge those amounts to your stored payment method via Stripe.

If your card is declined, no payment will be charged and the scheduled service will be automatically cancelled. You may provide an alternative card to proceed with the booking.

Your payment details are processed and stored securely by Stripe and are used solely for processing bookings on the website. PresRide reserves the right to use other reputable payment processors if needed.

PresRide may also process payments through integrated, white-label dispatch and booking platforms that store tokenized payment credentials (and not full card numbers) for the purpose of authorizing, capturing and settling charges related to your trips, including but not limited to base fares, tolls, surcharges, waiting time, cleaning fees, damage fees and other ancillary charges described in these Terms and in the applicable tariff schedule. By adding a payment method to your PresRide account or through the PresRide mobile application, you grant PresRide continuing authorization to place holds on funds and to charge your payment method for all amounts you incur in connection with the services, including any post-trip adjustments and additional charges lawfully applied after the service is completed.

In case you identify any inconsistency or unauthorized charge in your billing, you must notify PresRide immediately through our contact details. We will review your case and coordinate with Stripe or the relevant payment processor to resolve the issue promptly. Please note that PresRide cannot be held responsible for delays or errors attributable to the payment processor, but we will provide all reasonable assistance to support your claim.

PresRide enables the booking or payment of services directly through the PresRide mobile application, the same payment terms, methods, responsibilities and dispute processes contained in this section shall apply to such in-app transactions, unless expressly stated otherwise.

6. CANCELLATIONS AND REFUNDS

Cancellations made at least 24 hours before the scheduled service time are eligible for a full refund.

Cancellations made less than 24 hours before the scheduled service time will be subject to a charge equal to 50% of the total service value.

In case of no-show, the full service fee will be charged.

PresRide reserves the right to cancel a service without liability when due to force majeure, extreme weather conditions, technical failures, safety concerns, or unforeseen circumstances that prevent proper service delivery. In such cases, the client will be notified immediately, and a rescheduling or refund will be offered.

7. DISCLAIMER

By accessing the website and the content available on the website, you accept personal responsibility for the results of using the information available on the content. You agree that PresRide has not guaranteed the results of any actions taken, whether or not advised by this website or the content.

PresRide provides resources and content for informational purposes only. We do not guarantee that the information available on the website is accurate, complete or updated. The content of this website is provided for general information and should not be taken as a professional advice. Any use of the material provided on this website is at your own risk.

8. INTELLECTUAL PROPERTY AND COPYRIGHT

All materials on PresRide, including, without limitation, names, logos, trademarks, images, text, columns, graphics, videos, photographs, illustrations, software, and other elements are protected by copyrights, trademarks, and/or other intellectual property rights owned and controlled by PresRide or by third parties that have licensed or otherwise provided their material to the website.

Additionally, the PresRide brand, its logo, website, applications, texts, images, graphic and audiovisual materials, and all related content are the exclusive property of PresRide and are protected by applicable intellectual property laws.

You acknowledge and agree that all materials on PresRide are made available for limited, non-commercial, personal use only. Except as specifically provided herein, no material may be copied, reproduced, republished, sold, downloaded, posted, transmitted, or distributed in any way, or otherwise used for any purpose, by any person or entity, without PresRide’s prior express written permission.

You may not add, delete, distort, or otherwise modify the material. Any unauthorized attempt to modify any material, to defeat or circumvent any security features, or to utilize PresRide or any part of the material for any purpose other than its intended purposes is strictly prohibited.

9. COPYRIGHT INFRINGEMENT

PresRide will respond to all inquiries, complaints and claims regarding alleged infringement for failure to comply with or violation of the provisions contained in the Digital Millennium Copyright Act (DMCA). PresRide respects the intellectual property of others, and expects users to do the same. If you believe, in good faith, that any material provided on or in connection with the website infringes your copyright or other intellectual property right, please send us your copyright infringement request pursuant to Section 512 of the Digital Millennium Copyright Act (DMCA), via our contact information, with the following information:

Identification of the intellectual property right that is allegedly infringed. All relevant registration numbers or a statement regarding ownership of the work should be included.

A statement that specifically identifies the location of the infringing material, in sufficient detail so that PresRide can find it on the website.

Your name, address, telephone number and email address.

A statement by you that you have a good faith belief that the use of the allegedly infringing material is not authorized by the copyright owner, or its agents, or by law.

A statement by you, made under penalty of perjury, that the information in your notification is accurate, and that you are the copyright owner or authorized to act on its behalf.

An electronic or physical signature of the copyright owner or of the person authorized to act on the copyright owner’s behalf.

10. LICENSE TO USE THE PLATFORM AND SERVICES

PresRide grants you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the platform that PresRide provides to you as part of the services. This license is for the sole purpose of allowing you to use and enjoy the benefit of the services provided by PresRide, in the manner permitted by these terms. You may not copy, modify, distribute, sell or rent any part of our services or the included software, nor may you reverse engineer or attempt to extract the source code of such software, unless such restrictions are prohibited by law or you have our written permission.

You agree not to use the website and services in a negligent, fraudulent or unlawful manner. The user also agrees not to engage in any conduct or action that may damage the image, interests or rights of the PresRide website or third parties.

This service prohibits the sending of messages or mass e-mails that: (1) Any messages that are categorized as SPAM. (2) Have harassing, abusive, defamatory, obscene, bad faith, unethical or otherwise unlawful content (3) Distribute Trojan horses, viruses or other malicious computer software (4) Are intended to commit fraud or impersonation, (5) distribute intellectual property without having ownership or a license to distribute such property (6) violate, in any way, the terms of service, privacy policy or rules of this website or the recipients.

PresRide reserves the right to terminate your access immediately, with or without notice, and without liability to you, if PresRide believes that you have violated any of these terms or interfered with use of the website or services.

11. CONFIDENTIAL INFORMATION

Information provided by our clients through our services will be treated as confidential information and will be used solely for the purpose of providing our services properly. PresRide will protect such confidential Information from disclosure to third parties by employing the same degree of care used to protect its own confidentiality or proprietary information of similar importance. If necessary to carry out a prospective business relationship, PresRide may disclose confidential information received pursuant to our services to employees and/or consultants with a need to know, provided that the consultants are obligated to protect such confidential information from unauthorized use and disclosure.

Confidential information shall not be disclosed to any third party without the prior written consent of the customer who is the owner of the information.

12. PERSONAL DATA

Any personal information you submit in connection with the services and use of the website will be used in accordance with our privacy policy. By using the services, you agree that we may collect and store your personal information. Please see our privacy policy.

13. PROHIBITED ACTIVITIES

The content and information available on the website (including, but not limited to, data, information, text, music, sound, photos, graphics, video, maps, icons or other material), as well as the infrastructure used to provide such content and information, is proprietary to PresRide or licensed to PresRide by third parties. For all content other than your content, you agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell or re-sell any information, software or services obtained from or through the website. In addition, the following activities are prohibited:

Access, monitor, reproduce, distribute, transmit, broadcast, display, sell, license, copy or otherwise exploit any content of the services, including but not limited to, using any robot, spider, scraper or other automated means or any manual process for any purpose not in accordance with this agreement or without our express written permission.

Violate the restrictions in any robot exclusion headers on the services or bypass or circumvent other measures employed to prevent or limit access to the services.

Take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure.

Deep-link to any portion of the services for any purpose without our express written permission.

“Frame”, “mirror” or otherwise incorporate any part of the services into any other websites or service without our prior written authorization.

Attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by PresRide in connection with the services.

Circumvent, disable or otherwise interfere with security-related features of the services or features that prevent or restrict use or copying of any content.

Download any content unless it’s expressly made available for download by PresRide.

14. DISCLAIMER OF WARRANTIES

Because of the nature of the Internet, PresRide provides and maintains the website on an “as is”, “as available” basis and makes no promise that use of the website will be uninterrupted or entirely error free. We are not responsible to you if we are unable to provide our Internet services for any reason beyond our control.

Our website may from time to time contain links to other websites which are not under the control of and are not maintained by us. These links are provided for your convenience only and we are not responsible for the content of those sites.

Except as provided above we can give no other warranties, conditions or other terms, express or implied, statutory or otherwise and all such terms are hereby excluded to the maximum extent permitted by law.

You will be responsible for any breach of these terms by you and if you use the website in breach of these terms you will be liable to and will reimburse PresRide for any loss or damage caused as a result.

PresRide will not be liable in any amount for failure to perform any obligation under this agreement if such failure is caused by the occurrence of any unforeseen event beyond its reasonable control including without limitation Internet outages, communications outages, fire, flood, war or act of God.

These terms do not affect your statutory rights as a consumer which are available to you.

Subject as aforesaid, to the maximum extent permitted by law, PresRide excludes liability for any loss or damage of any kind howsoever arising, including without limitation any direct, indirect or consequential loss whether or not such arises out of any problem you notify to PresRide and PresRide shall have no liability to pay any money by way of compensation, including without limitation all liability in relation to:

Any incorrect or inaccurate information on the website.

The infringement by any person of any Intellectual Property Rights of any third party caused by their use of the website or service purchased through the website.

Any loss or damage resulting from your use or the inability to use the website or resulting from unauthorized access to, or alteration of your transmissions or data in circumstances which are beyond our control.

Any loss of profit, wasted expenditure, corruption or destruction of data or any other loss which does not directly result from something we have done wrong.

Any amount or kind of loss or damage due to viruses or other malicious software that may infect a user’s computer equipment, software, data or other property caused by persons accessing or using content from the website or from transmissions via emails or attachments received from PresRide.

All representations, warranties, conditions and other terms which but for this notice would have effect.

For the avoidance of doubt, the exclusions and limitations in this section also apply to the PresRide mobile application and any of its features, including but not limited to real-time tracking, notifications, account access and any functionalities that may from time to time be unavailable or limited due to maintenance, updates, technical failures or circumstances beyond PresRide’s reasonable control.

15. LIMITATION OF LIABILITY

PresRide shall not be held liable for delays caused by traffic, road closures, adverse weather conditions, government actions, force majeure events, or any other circumstances beyond its reasonable control.

PresRide’s liability shall be limited solely to the value of the contracted service.

Under no circumstances shall PresRide be held liable for indirect or consequential damages, loss of profits, business opportunities, or any harm resulting from the use of its services.

16. ELECTRONIC COMMUNICATIONS

No responsibility will be accepted by PresRide for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, internet accessibility or availability or for traffic congestion or unauthorized human act, including any errors or mistakes.

17. INDEMNIFICATION

You agree to defend and indemnify PresRide from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

Your breach of this agreement or the documents referenced herein.

Your violation of any law or the rights of a third party.

Your use of the services.

18. THIRD-PARTY PLATFORMS, APP STORES AND TECHNOLOGY PROVIDERS

The PresRide mobile application may be made available for download through third-party platforms such as the Apple App Store and Google Play Store. You acknowledge and agree that:

(a) These Terms and Conditions are concluded between you and PresRide only, and not with Apple Inc., Google LLC, or any of their subsidiaries or affiliates. Apple and Google are not responsible for the application, its content or the services provided through it.

(b) Apple and Google have no obligation whatsoever to furnish any maintenance or support services with respect to the PresRide mobile application.

(c) To the maximum extent permitted by applicable law, Apple and Google shall have no other warranty obligation whatsoever with respect to the application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of the application to conform to any warranty will be the sole responsibility of PresRide, subject always to the limitations and exclusions of liability set out in these Terms and Conditions.

(d) PresRide, and not Apple or Google, is responsible for addressing any claims by you or any third party relating to the PresRide mobile application or your possession and/or use of that application, including but not limited to: (i) product liability claims; (ii) any claim that the application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

(e) In the event of any claim by a third party that the PresRide mobile application or your possession and use of that application infringes that third party’s intellectual property rights, PresRide, and not Apple or Google, will be solely responsible for the investigation, defense, settlement and discharge of any such claim, to the extent required by these Terms and applicable law.

(f) You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

(g) You acknowledge and agree that Apple and Apple’s subsidiaries, and Google and Google’s subsidiaries, are third-party beneficiaries of these Terms and Conditions with respect to the PresRide mobile application, and that, upon your acceptance of these Terms and Conditions, Apple and Google shall have the right (and will be deemed to have accepted the right) to enforce these Terms and Conditions against you as third-party beneficiaries.

In addition, PresRide may use third-party technology providers and white-label platforms to enable booking, dispatching, tracking, notifications, account management and other operational functions. Such providers act as technology enablers only and do not provide transportation services themselves. 

19. CHANGES AND TERMINATION

We may change the website and these terms at any time, in our sole discretion and without notice to you. You are responsible for remaining knowledgeable about these terms. Your continued use of the site constitutes your acceptance of any changes to these terms and any changes will supersede all previous versions of the terms. Unless otherwise specified herein, all changes to these terms apply to all users. Furthermore, we may terminate this agreement with you under these terms at any time by notifying you in writing (including by email) or without any warning.

PresRide may also update, modify, suspend or discontinue any feature or functionality of the PresRide mobile application, including but not limited to booking tools, trip tracking, notifications and payment-related features, at any time and without prior notice, for maintenance, security, legal or operational reasons. Where reasonably possible and required by law, PresRide will inform users of material changes or discontinuation of critical features.

20. ASSIGNMENT

This agreement and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by PresRide without restriction.

21. INTEGRATION CLAUSE

This agreement together with the privacy policy and any other legal notices published by PresRide, shall constitute the entire agreement between you and PresRide concerning and governs your use of the website and the services.

22. DISPUTES

The user agrees that any dispute, claim or controversy arising out of or relating to these terms and conditions, or the breach, termination, enforcement, interpretation or validity thereof or the use of the services, shall be resolved by binding arbitration between the user and PresRide, provided that each party retains the right to bring an individual action in a court of competent jurisdiction.

In the event of a dispute arising in connection with the use of the services or the breach of these conditions, the parties agree to submit their dispute to arbitration resolution before a reputable arbitration organization as mutually agreed by the parties and in accordance with applicable commercial arbitration rules.

You agree to initiate a formal dispute proceeding by sending us a communication through our contact information. PresRide may choose to send you a written offer after receiving your initial communication. If we offer and send you a settlement offer and you do not accept the offer, or we are unable to resolve your dispute satisfactorily and you wish to continue with the dispute process, you must initiate the dispute resolution process before an accredited arbitration organization and file a separate Demand for Arbitration. Any award rendered by the arbitration tribunal shall be final and conclusive on the parties.

To the fullest extent permitted by law, you agree that you will not file, join or participate in any class action lawsuit in connection with any claim, dispute or controversy that may arise in connection with your use of the website and services.

The courts of the United States, specifically the courts located in the State of New York, shall have jurisdiction over any dispute, controversy or claim relating to PresRide and its business operations. Any such dispute or controversy shall be brought and resolved in the courts of the United States, specifically the courts located in the State of New York.

23. FINAL PROVISIONS

These terms and conditions are governed by the laws of the United States. Use of the website and services are not authorized in any jurisdiction that does not give effect to all of the provisions of these terms.

Our performance of these terms is subject to existing laws and legal process, and nothing contained in these terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of our website or information provided to or gathered by us with respect to such use.

If any part of these terms is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions will not in any way be affected or impaired. Our failure or delay in enforcing any provision of these terms at any time does not waive our right to enforce the same or any other provision(s) hereof in the future.

Any rights not expressly granted herein are reserved.

PresRide transportation services are primarily intended to be provided within authorized operational territories, which may be limited to specific cities, regions or states (including but not limited to areas within the State of New York). The availability of the website or mobile application in other locations does not imply or guarantee that transportation services are offered or can be provided in such locations.
